All engagement of Groundwork workers must run through Groundwork. Last updated: May 2026.
1. Engagement through Groundwork only
All communication, scheduling, briefing, supervision arrangements, timesheet approval, rate negotiation and invoicing in respect of any worker introduced to you by Groundwork Labour Hire ("Groundwork") must be conducted through Groundwork. You must not contact any worker directly by phone, SMS, email, social media or in person to arrange, extend, vary or pay for work outside of the Groundwork platform.
2. No direct contact / non-solicitation
You agree that, for a period of twelve (12) months from the date a worker is first introduced or placed on your site by Groundwork, you will not (whether directly or through any related entity, employee, agent or labour-hire company) (a) request or accept the personal contact details of any Groundwork worker, (b) engage, employ, sub-contract, hire, refer or place that worker on any site, or (c) solicit or induce any Groundwork worker to leave Groundwork. This restriction applies whether or not the worker initiates the contact.
3. Circumvention fee
If you breach clause 1 or clause 2, you agree to pay Groundwork a circumvention and recruitment fee as a genuine pre-estimate of Groundwork's loss (including recruitment, onboarding, training, insurance and lost margin). The applicable fee will be advised by Groundwork in writing and is payable within 14 days of invoice.
4. Charge rates and invoicing
Charge rates quoted by Groundwork are inclusive of contractor pay, statutory on-costs, public liability insurance and Groundwork's margin. Workers are paid by Groundwork. You must not pay any worker directly, in cash or otherwise, for work arranged through Groundwork. All hours worked must be captured on a Groundwork timesheet and approved by your authorised site representative.
5. Site safety and supervision
While a worker is on your site you are the host employer for work health and safety purposes. You agree to provide a safe place of work, induct the worker, provide reasonable supervision, and report any incident, near miss or injury to Groundwork within 24 hours.
6. Cancellation
Bookings cancelled at short notice may incur a cancellation charge as advised by Groundwork at the time of booking.
7. Worker conduct concerns
If you have any concern about a worker's performance, conduct or fitness for work, contact Groundwork immediately on 0450 752 777. Do not discipline, stand down or terminate a Groundwork worker directly.
8. Confidentiality
Worker contact details, rates, tickets and personal information disclosed to you in the course of a placement are confidential information of Groundwork and must only be used for the purpose of supervising that placement.
9. Governing law
These terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of NSW.
10. Acceptance
By submitting a request for workers, accepting a worker onto site, or paying a Groundwork invoice, you confirm you have read, understood and agree to be bound by these terms.
