Worker Terms & Conditions
All client work and payment must run through Groundwork. Last updated: May 2026.
1. All work runs through Groundwork
Every job, shift, rate, timesheet and payment for work introduced to you by Groundwork Labour Hire ("Groundwork") must be arranged and processed through Groundwork. You must not accept work directly from, invoice directly to, or be paid in cash by, any client introduced to you by Groundwork.
2. No personal contact details exchanged
You must not give your personal phone number, email, social media handles or bank details to a Groundwork client, and you must not accept the personal contact details of a client representative for the purpose of arranging work outside Groundwork. If a client asks you to take a job direct, advise them to contact Groundwork on 0450 752 777 and notify Groundwork the same day.
3. Non-circumvention (12 months)
For a period of twelve (12) months following your last placement, you agree not to (a) accept work directly or indirectly from any client introduced to you by Groundwork, (b) work for that client through any other labour-hire company, or (c) solicit other Groundwork workers to do the same. This applies whether the client or you initiates contact.
4. Liquidated damages for breach
If you breach clause 1, 2 or 3, you agree to pay Groundwork an amount as a genuine pre-estimate of Groundwork's loss (recruitment, onboarding, lost margin and goodwill), as advised by Groundwork in writing. Groundwork may also remove you from its register and, where lawful to do so, report the breach to other labour-hire operators in the industry.
5. Independent contractor
You are engaged as an independent contractor, not an employee. You must hold a current Australian Business Number (ABN), arrange your own personal accident and income protection cover, and account for your own tax and superannuation. Groundwork does not provide workers compensation insurance for contractors.
6. Tickets and licences
You confirm that all tickets, licences and certifications you have declared are current and valid, and you agree to provide copies on request. Notify Groundwork immediately if any licence expires, is suspended or is cancelled.
7. Conduct on site
While on a client site you must comply with all WHS legislation, the client's site rules, and the reasonable directions of the site manager. Failure to do so may result in removal from site and termination from the Groundwork register.
8. Concerns and disputes
If you have any concern about safety, pay, hours, or the conduct of a client representative, contact Groundwork immediately on 0450 752 777. Do not attempt to resolve pay or scope disputes directly with the client.
9. Governing law
These terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of NSW.
10. Acceptance
By registering, accepting a job offer, or submitting a timesheet through Groundwork, you confirm you have read, understood and agree to be bound by these terms.
